Vehicles

We are proposing to add new sub-clauses relating to vehicle access on public land.

These changes affect sections 107 and 127.

Current:

(1) The owner and occupier of land must ensure that each point of vehicular access from a Road to the land has an appropriately constructed vehicle crossing.

(2) A person must not cause, allow or drive a Motor Vehicle from or onto land other than by an appropriately constructed vehicle crossing.

(3) Council may serve a Notice to Comply on the owner and occupier of land requiring the repair, removal or replacement of a vehicle crossing.

Proposed:

(4) A person must not construct a vehicle crossing without a permit. Refer to Vehicle Crossing Policy and Procedures and Protocols Manual for permit assessment requirements and interpretations.

Rationale:

This amendment will clarify expectations that a vehicle crossing permit must be sought prior to the construction (or planned construction) of a vehicle crossing.

Current:

No sub-clause exists.

Proposed:

Council has the authority to remove vehicles that are obstructing asset renewal and maintenance works

Council will provide notice to affected residents via letter drops prior to the works. Video message boards may also be used if required and if circumstances prevail.

Council will return cars to their previous position once the works have been completed.

Rationale:

This amendment will ensure access is maintained for asset maintenance and renewal works such as road reconstructions, drain cleaning and resurfacing.
